European Court bans GMO potato on Hungary’s action

The General Court of the European Union annulled a decision of the European Commission which authorised the marketing of the genetically modified potato Amfora. After a procedure lasting more than five years, the Commission gave its nod in 2010, but while doing so, it „departed from the rules of the authorisation procedures”, the Court said. If it „had complied with the rules, the result of the procedure or the content of the contested decision could have been substantially different”, the Court ruled. Taking the view that the Amflora potato presents a risk to human and animal health and also to the environment, Hungary brought an action for annulment of the Commission’s authorisation decision, the Court recalled in a statement, adding that France, Luxembourg, Austria and Poland intervened in the proceedings in support of Hungary.
